Terms of Service

By accessing or using Perfolio, you agree to these Terms and our Privacy Policy. If you use Perfolio for an organization, you represent that you have authority to bind that organization. A signed enterprise agreement or order form controls if it conflicts with these Terms.

You must be at least 16 and able to form a binding contract where you live. You may not use Perfolio where doing so is prohibited by applicable law.

You are responsible for your account, the accuracy of information you provide, and reasonable protection of your sign-in credentials. Tell us promptly if you suspect unauthorized access. You may use connected accounts only where you have authority and where your use complies with your employer's rules and the applicable provider's terms.

Perfolio organizes and presents information; it does not independently verify your work, employer policies, or eligibility for a promotion, bonus, or role. You are responsible for reviewing anything you submit, export, publish, or share.

As between you and Perfolio, you retain your rights in content you submit or connect (“Your Content”). You grant Perfolio a limited, non-exclusive, worldwide right to host, copy, decrypt, process, transmit to the disclosed providers needed for requested features, display to you, and create outputs from Your Content solely to operate, secure, support, and improve Perfolio as described in the Privacy Policy.

You represent that you have the rights and permissions needed to provide Your Content and authorize any connected account. You must not upload trade secrets, confidential employer material, personal information about others, or regulated data unless you are authorized and the use is lawful. You choose whether to share a packet, publish content, or create a link; anyone you share with may view the material you make available to them.

AI features may generate drafts, suggestions, summaries, classifications, and recommendations. They can be inaccurate, incomplete, or unsuitable. They are not professional employment, legal, financial, or human-resources advice, and they do not make employment, promotion, compensation, or other similarly significant decisions.

Where a feature proposes a change to your career record, you decide whether to accept, edit, or reject it. You must review AI output before relying on it or sharing it. Perfolio uses the paid tier of the Google Gemini API for applicable AI features. Our handling of AI inputs and outputs, including the limits of Google's paid-service commitments, is described in the Privacy Policy.

You may not use Perfolio to:

• misrepresent work, fabricate evidence, impersonate another person, or deceive an employer or reviewer;
• access another person's account or connected services without authorization;
• circumvent rate limits, permissions, authentication, security controls, or connector scopes;
• reverse engineer, interfere with, overload, resell, scrape, or use the service to build a competing service except where law prohibits that restriction; or
• use the service unlawfully, abusively, or in a way that infringes another person's rights or violates a provider's terms.

Some features require a paid plan. Prices, included limits, and billing intervals are shown before purchase. Payments are processed by Stripe; Perfolio does not store raw payment-card details. Paid subscriptions renew automatically until cancelled where permitted by law. You can cancel through billing settings, and access normally continues through the paid period.

Fees are non-refundable except where required by law or expressly stated at purchase. You are responsible for applicable taxes. We may change plans, prices, or limits prospectively with notice required by law; a current paid term is not changed retroactively unless you agree or law permits it.

Perfolio, its software, designs, documentation, and branding are owned by Perfolio or its licensors and are protected by applicable law. These Terms grant you a limited, personal, non-transferable, revocable right to use the service during your subscription or permitted access. They do not transfer ownership of Perfolio.

If you send feedback, you grant us a non-exclusive, perpetual, irrevocable, worldwide, royalty-free right to use it without compensation or obligation, provided we do not identify you as the source without permission.

We may modify, suspend, or discontinue features, including third-party connections, when needed for security, legal compliance, provider changes, or product operation. We will use reasonable efforts to give advance notice of material discontinuations when practical. We do not guarantee uninterrupted or error-free availability.

You may stop using Perfolio at any time. We may suspend or terminate access if you breach these Terms, create security or legal risk, fail to pay fees, or where necessary to protect the service or others. On termination, you may export available data before access ends where practical and legally permitted. Sections that by their nature should survive will survive termination.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERFOLIO IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE SERVICE. WE DO NOT WARRANT THAT AI OUTPUT, CONNECTED-SERVICE DATA, OR USER CONTENT IS ACCURATE, COMPLETE, OR FIT FOR A PARTICULAR PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERFOLIO AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO PERFOLIO FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR US$100 IF YOU PAID NOTHING. These limits do not exclude liability that law does not allow us to exclude or limit.

You agree to indemnify Perfolio and its personnel against third-party claims arising from Your Content, your unauthorized use of connected accounts, or your breach of these Terms, to the extent permitted by law. If a provision is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver.

Mandatory consumer-protection laws in your place of residence remain applicable. If you have a separate enterprise agreement, its governing-law and dispute provisions control. We may update these Terms to reflect product, legal, or security changes. For material changes, we will update the date above and provide additional notice where required. Continued use after the effective date means you accept the updated Terms to the extent permitted by law.
